These “Terms and Conditions” apply to any physical or moral person, hereafter called “the participant(s) / client(s)”

The subscriber booking for other participants certifies that each participant, or legal representant for minors, is aware of the following general sales conditions and that all of them individually accept these conditions.

CANCELLATIONS AND REFUNDS :

Cancellations on the decision of the client

1) For any partial or total cancellation of the client occurring within 48 hours before the starting time of the activity, the payment of the total amount will be due. No refund will be possible. There will be no possible refund.

2) For any partial or total cancellation of the client occurring before the 48hour period, 25 % of the total amount will be due, as expressed in article L.121-20-4 of French code du commerce.

3) For any cancellation of one or several participant(s) in case of force majeure (injury, sickness, mourning…), justified with a proof : medical certificate or formal act, OXO Canyoning will graciously offer two options :

• 50 % payback of the prevented person(s)
• rescheduling of the outing with at 25 % extra cost. Valid during the current year and depending on OXO canyoning’s availabilities.

For a person under age 18, OXO will offer these possibilities to the child and one adult.

Cancellation & rescheduling on OXO canyoning’s decision

1) OXO canyoning reserves the right to cancel an outing in case of a technical impossibility or in case a minimum number of 5 participants to the outing has not been reached. A solution will be offered to the client to postpone the outing.

2) The decision to cancel an outing because of weather conditions hazards belongs to the guide(s) or instructor(s) in charge of the security of the groupe and only to them. This decision can not be contested. A solution will be offered to the client in order to change excursion or change date.

3) The decision to cancel an outing because of weather conditions hazards belongs to the guide(s) or instructor(s) in charge of the security of the groupe and only to them. This decision can not be contested.

4) In case of the cancellation of the outing on OXO canyoning’s decision or on the guide’s decision, all previously paid sums should be refunded

5) For any service corresponding to an amount exceeding 1000 € and cancelled because of weather conditions hazards, OXO canyoning will refund the client’s deposit reduced by 10 % of the total amount, as payment for the organisation of the service.

HOURS AND DELAYS :

Following a booking, participants will receive precise information regarding meeting places and times. For the comfort of all participants, a delay of 20 mn will be tolerated. Following this delay, the group would be going for the outing with no possible refund for the late client.

DIPLOMAS AND LEGAL STATUS :

OXO Canyoning guides and instructors are recruited for their professional and human qualities. They are designated by “the guide”.

According to French legal requirements, required qualifications are :

• DE canyoning or rock climbing (depending on the activity)
• BEES canyoning or rock climbing
• Guide de Haute Montagne + canyoning certification
• AMM & BEES spéléo + canyoning certification

They are independant workers registered at URSSAF and up-to-date with the payment of their assessments, as well as their professional civil liability insurance.

Matchmaker status of OXO canyoning SARL

OXO canyoning has the role of a business matchmaker between the client and the guide in charge of the outing.

The sale of the guiding service by OXO canyoning SARL is executed in the name and on the acount of the guide in charge of the outing.

The outdoor outing is happening under the unique and strict liability of the guide in charge. OXO canyoning SARL is reliable for organisation and commercial details only. OXO canyoning SARL liability shouldn’t be engaged in case of an accident engaging the risponsability of the guide in charge of the outing.

INSURANCES :

OXO canyoning guides and instructors are covered by a professional civil liability insurance.
This insurance efficiently covers for medical care, hospital costs, search expanses, repatriation expanses and compensations for the risks the professional is responsible for.

It is strongly recommended to the client to be covered for harm caused or suffered by him(her) during events or accidents that are not part of the guide or instructor’s liability, during the activity..

RISK ASSESSMENT :

– Activities offered by OXO canyoning are outdoors sport adventures. Each participant is aware to be moving onto slippery and steep grounds and acknowledges the random, changing and hard to foresee character of our practice range and of the weather conditions.

– Participants have access on the website www.oxo-canyoning.fr and through OXO’s booking service to all details of the activity they are engaging in. They must thoroughly seek for information and not over-estimate their own or their children’s physical or psychological capacities.

– During the security briefing and the instruction delivery, participants must pay close attention and only engage if they have clearly understood the guide or instructor’s instructions.

– OXO canyoning declines any responsability in case of loss or deterioration of client’s belongings during the activity, such as photo or video cameras, smartphones, prescription or sun glasses, contact lenses…

COUNTRAINDICATIONS :

In order to take part to the sport activities offered by OXO canyoning :

• Participants must not have any health contraindications to practicing these activities, neither have had any prior health problem or surgical operation that could make it dangerous.
• Participants having health specificities, physical or mental disability or a medical treatment must keep OXO informed of it at the booking to let the guide organise the outing accordingly and offer the best comfort and security conditions to all.
• Being under the effect of alcool or drugs is forbidden.
• Pregnant women must be aware of potentially serious, indeed lethal fetal injuries in case of falling or sliding.

To practice canyoning, participants must :

• For “Happy Balme” outings, be comfortable to move about in the water and accept to have one’s head underwater for 2 seconds. and point to the guide the less comfortable children.
• For the other outings, it is necessary to be able to swim.
